Terms of Service

PostCrows provides tools to generate social media content using artificial intelligence, render it into post-ready formats, schedule it, and publish it to your connected social media accounts (currently TikTok). We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. You are responsible for keeping your own copies of any content that matters to you; we are not liable for any loss of content.

You must be at least 18 years old and able to form a binding contract to use the Service, and you must not be barred from using it under applicable law. If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.

To use the Service you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@postcrows.com if you believe your account has been compromised. We are not liable for losses caused by unauthorized use of your account.

To publish on your behalf, you connect third-party accounts (such as TikTok) using their authorization process. You authorize PostCrows to access those accounts and to take the actions you direct, such as posting and scheduling content. Your use of any connected platform is also governed by that platform's own terms — including the TikTok Terms of Service — and you are responsible for complying with each platform's rules, including those relating to automation and authentic engagement.

The Service uses AI to generate content based on the inputs you provide. AI output may be inaccurate, incomplete, generic, or unintentionally similar to existing content. You are solely responsible for reviewing, editing, and ensuring that any content you publish is accurate, lawful, sufficiently original, and compliant with the policies of the platforms you post to. PostCrows does not guarantee any particular outcome, including reach, engagement, follower growth, or monetization.

You retain ownership of the content you create, upload, or generate using the Service ("User Content"). You grant PostCrows a limited, worldwide, non-exclusive, royalty-free license to host, store, process, render, transmit, and publish your User Content solely as needed to operate the Service and to perform the actions you request (such as posting to your connected accounts). You represent and warrant that you have all rights necessary to your User Content and that it does not violate any law or any third party's rights.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
• Create or publish content that is illegal, infringing, defamatory, harassing, deceptive, spammy, or that violates any platform's policies;
• Impersonate any person or entity or misrepresent your affiliation;
• Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its security features;
• Use the Service to generate or distribute spam, or to operate automation that violates a connected platform's rules; or
• Take any action that imposes an unreasonable or disproportionate load on our infrastructure.

You are responsible for ensuring your use of the Service complies with TikTok's and any other connected platform's community guidelines and developer policies.

Some features of the Service may require payment. Where fees apply, they will be presented to you before you are charged, are quoted in U.S. dollars, and are non-refundable except as stated in these Terms or required by law. Paid plans may be offered as subscriptions that automatically renew until cancelled; you must cancel before a renewal date to avoid being charged for the next period, through your account settings or by contacting hello@postcrows.com. We may change our pricing with reasonable notice. You are responsible for any applicable taxes.

The Service and all associated materials — including its software, design, graphics, and content (excluding your User Content) — are owned by PostCrows or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Service. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

The Service integrates third-party services (such as TikTok and AI providers). We are not responsible for third-party services, their availability, or their content, and your use of them is subject to their respective terms and privacy policies.

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if you violate these Terms. Upon termination, your license to use the Service immediately ends. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PostCrows disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any content generated or any post published will achieve any particular result.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PostCrows WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

You agree to indemnify, defend, and hold harmless PostCrows and its affiliates from any claims, damages, losses, liabilities, and costs (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any connected platform's rules.

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the courts located in Toronto, Ontario, Canada, and you consent to their personal jurisdiction. Nothing in this section limits either party from seeking injunctive relief.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
